Welcome to Tonviewer! These Terms of Use ("Terms") govern your use of the Tonviewer website and all associated sites linked to Tonviewer, its subsidiaries and affiliates, (collectively, the “Site”). By accessing or using the Site , you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Site. As long as you comply with these Terms, Tonviewer grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site along with its connected services, subject always to the specific terms of use set out for the relevant connected services.
1. Acceptable Use
You agree to not use the Site for any purpose that is unlawful or prohibited by these Terms, or solicit the performance of any illegal activity or other activity which infringes the rights of Tonviewer or others.
You shall not engage in any activities that: - Violate any local, national or international laws or regulations, or any third-party rights. - Are unlawful or fraudulent or have any unlawful or fraudulent purpose or effect. - Bully, insult, intimidate or humiliate any person. - Involve sending, knowingly receiving, uploading, downloading, sharing, posting or re-using any material which does not comply with our content standards. - Transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam). - Lead to infringement any copyright, patent, database right or trademark of any other person. - Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity or deceive any person - Interfere with or disrupt the operation of the Site or the servers and networks connected to the Site. - Collect or store personal data about other users without their consent. - Transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware. - Attempt to gain unauthorized access to any portion of the Sites or any other systems or networks or to any of the connected services offered on or through the Site, by hacking, password ‘mining’ or any other illegitimate means.
All user content much be accurate (where it states facts), only contain opinions that are genuinely held and must comply with the law applicable if any country from which it is posted and to which the website is targeted.
2. Intellectual Property
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code including but not limited to the design, structure, selection and coordination of such Content, contained on the Site is owned, controlled or licensed by or to Tonviewer and is protected by copyright, patent, trademark laws and various other intellectual property rights and unfair competition laws. Except as expressly provided in these Terms of Use or those of any connected services within the website, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, service, Web site or other medium of publication or distribution or for any commercial enterprise without the explicit prior written consent from Tonviewer.
3. Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis. We do not make any warranties or representations regarding the accuracy, reliability, or completeness of the content on the Site or any connected services arising from the use of the Site. Your use of the Site is at your own risk. We disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We disclaim any and all liability for the acts, omissions and conduct of any third parties in connection with or related to the use of the Site and its connected services. Your sole remedy against use for dissatisfaction with the Site and any linked sites is to stop using the Site and any such content. This limitation or relief is a part of the bargain between the user and us.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
We reserve the right to modify, suspense or termination operation of or access to the Site or any portion of it for any reason including but not limited to for the routine or non-routine maintenance or any other changes.

Except where prohibited by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages.
Notwithstanding other provisions of these Terms, if we are found liable to you for any damage or loss which arises out of or is in any way connection with your use of the Site, our liability shall in no event exceed the greater of the (1) the total of any subscription or similar fees with respect to any service on the Site paid in the six month prior to the date of the initial claim made against Tonviewer, or (2) such amount (USD) equivalent to the maximum limit applicable under our insurance policy (further details of which can be requested from us by contacting us in writing). Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.

You agree to indemnify and hold us harmless from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site and connected services, your violation of these Terms, or your violation of any rights of a third party.

8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
